      This is important as these lawsuits can truly impact how we elect a President going forward. The article below was taken from today’s The Bulletin (a Philadelphia newspaper).

      Maybe Obama can clear this up while he is in Hawaii visiting is grandmother...

      Here’s the article:

      A second lawsuit has been filed against Democratic presidential nominee Sen. Barack Obama over his lack of evidence of U.S. citizenship.

        

      Steven Marquis, a resident of Fall City, Wash., a town about 30 miles southeast of Seattle, filed a suit this month against Washington Secretary of State Sam Reed, demanding he verify Mr. Obama’s citizenship status.

      The complaint seeks specifically that the office of the Washington Secretary of State verify and certify that Mr. Obama is or is not a “natural born” citizen by producing original or certified verifiable official documents. The lawsuit argues that this certification should take place before the election to preclude a constitutional crisis.

      Mr. Marquis argues the secretary of state has the authority and duty to not only certify the voters but also and most importantly the candidates and in so doing prevent the wholesale disenfranchisement of voters who would had had an opportunity to choose from qualified candidates had the certification preceded the election process.

      Mr. Marquis’ lawsuit is the second to be filed seeking proof that Mr. Obama is a U.S. citizen qualified to run for the office of U.S. president. Philip Berg, an attorney who wants Mr. Obama to produce his original birth certificate, filed another suit in Pennsylvania earlier this year.

      “At this point, Mr. Obama has not allowed independent or official access to his birth records nor supporting hospital records,” wrote Mr. Marquis in a statement. “The Hawaii Health Department has violated Federal law by ignoring formal Freedom of Information requests for the same. Due to the facts and numerous other allegations that would challenge Mr. Obama’s fundamental qualifications for office, a Federal lawsuit was filed and is currently being heard in District Court, Pennsylvania.”

      The Pennsylvania case is being heard by Judge R. Barclay Surrick, who has not made any ruling in the case. When called by The Bulletin for information on when a ruling would be made, Judge Surrick declined to comment. President Bill Clinton appointed Judge Surrick to the 3rd Circuit in 2000.

      Mr. Obama has not produced his birth records for the lawsuits, choosing instead to file for dismissal, based on lack of standing from the plaintiff. Mr. Berg has said if Mr. Obama really has his documents, it should be easy for him to produce them. Since he has not, Mr. Berg argues Mr. Obama must be barred from participating in this year’s election.

      The Washington lawsuit demands injunctive relief directing Mr. Reed to carry out the duty of his office in this regard answering the formal complaints for verification of Mr. Obama and any other candidate appearing on the ballots issues through his office for which formal complaints have been received.

      The State of Hawaii has refused to release copies of Mr. Obama’s birth certificate, because the privacy statutes of the state prevent them from doing so. In Honolulu, Andy Martin, a longstanding critic of Mr. Obama, filed a lawsuit on Oct. 17, in an attempt to get the Hawaiian Department of Health to release Mr. Obama’s birth certificate records.

      “One of Mr. Obama’s most controversial and contentious issues that he has allowed to fester for years is the question of his birth certificate,” said Mr. Martin in a statement. “Mr. Obama has posted at least two versions, maybe more, of a ‘certificate’ on the Internet.

      “I want to see a certified copy issued by the State of Hawaii, not one issued by the State of Mr. Obama,” he continued. “Why Mr. Obama won’t allow direct access to his birth records is beyond me. But the closer we get to discovering the truth about Mr. Obama the more we understand why he is terrified of that truth.”

      Mr. Martin is known for his assertion that Mr. Obama is secretly a Muslim and has been accused of anti-Semitism.  

      According to the U.S. Constitution, “no person except a natural born citizen, or a citizen of the United States, at the time of the adoption of this constitution, shall be eligible to the office of president; neither shall any person be eligible to that office who shall not have attained to the age of 35 years, and been 14 years a resident within the United States.”

      All the lawsuits hope to produce Mr. Obama’s documents before the Nov. 4 election, certifying that voters will not unwittingly choose a candidate who cannot be sworn in without violating the Constitution

        • I think that WE the Voters have a right, no, have EVERY right to be allowed to see a certified copy issued by the State of Hawaii.  

          It boggles my mind as to WHY he will not allow it to be seen .  What is so secret about his birth certificate ?  What Kind of Games is Obama playing with the American people ? And Why are more Americans NOT up in arms about this.  

          If there is nothing to hide Obama, then present the birth certificate.  

          I hope that more people will start to make an outcry about this issue among others.

          I am flabergasted that any man (or women) having the type of history that he does can run for President, OR Senator for that matter.

        • I have heard this before, and from my understanding Obama’s mother is American and any American giving birth to any child anywhere automatically makes that child an American citizen and protected under American laws, for a time period, if I recall.  I think after the birth of the child the citzenship must be declared and and or applied for to prove US citzenship.  

          I will have to say the birth certifcate provided on Obama’s website appeared to be created by computer program and I believe even down to watermarks.  

          But even so.. I believe anyone born of at least one American Parent, is by all rights an American and it does matter if you give birth on the ocean, or south pole, if your an American, your child should be an American.

          It is an interesting topic that has not been brought to the fore front.

          Again, Im in no way suggesting Obama was not born in USA, I just believe him to be an American by virtue of his American mother and he has apparently chosen to be an American so why take that right of birth away from him ?  However if he was born abroad, why not just say so.  He is an American in my eyes, unless he legally gives up citizenship.

        • I think this whole issue is silly. (personally)  Mr. Obama is not STUIP, and he is very much aware of the laws, rules, and regulations of the Unites States regarding qualifying to be a canididate for presidency, (wether he was born in the U.S.A, or even attaind citizenship if born in another country}.  He’s quite knowledgeable or the laws.

          PLEASE give the man some creidt. he’s much smarter than that, to even assume that the issue would‘nt arise one day. He like most of us knows just how the “American People” go.

          They pick your life 2 threads, diggin, and plotting, and doing whatever they deem necesary to prove what it is they need to, especially if it will discredit a person, to make the public think you are decietful.

          Obama Is AMERICAN....

        • I just believe no matter what, if your a USA citizen, you could give birth anywhere and your child is a citizen.  If I recall you have to be a citizen to run for any office and president, so even if he wasent born here, I still think he would legally be a US Citizen.  

          Having said that, I dont agree of a forged birth certifcate and anyone running for President should not provide false documetation, which I dont know if he has or not.

          Hawaii will have to give a copy of birth certificate to FBI and Secret Service, to determine if its legal or not.  In my opinion they must have already cleared him ?  He has body guards, so Im assuming they have given Obama security clearance ??

          Again, I would expect any of my offspring to be citizens no matter where born unless they declared citizenship in another country.

          Interesting debate.

        • My concern is...regardless of our own opinions on this matter..what is the actual law about it? If he is running illeagally..yes....we the citizens should know about it. If they squeeze by this law...what good are any of our laws? Makes you wonder.

        • If the birth certificate is forged I think that could be the only legal problem if he presented it as a real document and it was not.  

          I think he is a citizen by virtue of his mother, but if he lied or submitted a forged document, that could be the legal problem, therefore ultimately would anul his candidacy as you cant lie on government applications, and Im assumming the submitted the document as proof of birth, however if the government document only asked if he was a US citizen and he said, yes, In my opinion he didnt lie as I think by his mother being a citzen he is a citizen.  

          So the question is did he submit a forged document to the government or not ?  Again just opinion over legal stuff, not conclusive, and this is based upon if documents were in fact forged or not.

          I’m just gonna have to trust that the ‘fact finders’ for both political parties did their jobs ahead of time, otherwise he WOULDN‘T BE ELIGIBLE FOR THE NOMINATION IN THE FIRST PLACE.

          There are so many smart women here, and it hurts my head to see y‘all get so fired up over the same old propaganda machines because you‘re so eager to believe you‘re being taken advantage of and lied to.  

          You are! It’s the political way!

          Please, folks, consider your sources and save your energies for topics that effect change, not controversy. There’s enough of that to last a dozen lifetimes already.

          Yeah, I think if his birth certificate were forged, we’d have probably knocked him out of the race 4 years ago when all this campaigning first started.

          And for Meshell—If ONLY Fox is running with it, why? You think EVERY news organization is acting in collusion, except Fox?  

          I am SICK TO DEATH of the liberal media label. Almost all talk radio is conservative.

          Feather & Teeky are right, whoever it is, is. We need to focus on the stuff that affects our immediate worlds. We really have no control over Washington.

          If we look hard enough, we can find almost anything to fit our purposes. That’s kind of my whole point here. The media will spin whatever it chooses, in whichever way is going to get the biggest reaction. And you‘re encouraging them by buying into it.

          I’ve been very careful on the few political threads I’ve bothered to interject on to not indicated a party preference. And I’ll keep it that way.

          Just call me Switzerland! :)

          However, since you bring up Bush... These same exact sorts of statements were being made about Bush regarding falsified military records. And it was all untrue! And the controversy and supposed lawsuits over the voting fiasco?

          Something to remember: Those who fail to remember history are doomed to repeat it!!

          In many/most cases, a child born outside the US to a US citizen or citizens is a US citizen by birth (and, in the opinions of most legal scholars, qualifies as a “natural born” citizen eligible to become President or Vice-President).

        • this discuss is interesting to me. the state of Hawaii in refusing to release his birht certificate is in fact acknowledging that they have one. With today’s issues of idenity theft we would know this. The fact that the four years of running for preseident, plus his time in the Senate and no one has made an issue of this in the major media market implies that there is not an issue to be made.
          During a time where there is real issues to address such as the high rate of unempolyment, the cost of living the fact that major institution around the world are going belly up that we would focus more on how to address thses issues. When he applied to run for president as it is with all candidates, his residency was established or else he would not be on the ballot.

        • I agree, I think that if Obama were not a legal citizen, I am sure the FBI and secret service would not have cleared him for his candidacy.  

          I feel strongly no matter where he was born he is a Citizen by virtue of his mother, no matter what age she was, as his mother was a citizen, natural born.

          Again, Hawaii could clear all this up immediately and make any accusation mute.  But even if he wasent born in USA I still think he is a citizen.. I have no doubt, his mother was a citizen.

          I find your statement offensive; to indicate that you know the truth, whereas all the legal and political handlers and see-to-it guys, and the rest of the country are being tricked is ludicrous and inflammatory.         • Nice, all of you have good points.  I really could care less to see his birth certificate personally, however, I think that since the question has been brought up, it should be mandated that he produce a certified copy to the Attorney who brought the suit, 1st in order to stop wasting money on a frivilous law suit, and secondly (if there’s nothing to hide) to rub it in his face and say nana nana nana, clear his name as being an untrustworthy person, and so we can get on with this.

          But ~ if there wasn’t controversy in politics, it wouldn’t be called that.
